justt finished reading some extracts of contract theory n hence these theories have been wandering aimlessly in my head....
despite having done legal theories last year, until now, i have absolutely no idea as to the significance of legal theories!!!! shameful as it is, having done a year of law, it is quite true. lecturers stress the significance of legal theories as they are 'the foundation of law as to how the law evolved from the age of reason to the modern day era'.... Big deal.. how am i supposed to apply these theories in e exams when i dun understand what e heck they are???? When you try to interpret/understand the relevance/significance of legal theory.. u realise tt every theory has a contradictory view to the idea... n hence.. ur perspective as to the manner in which the law works become totally wrecked.
It never ceases to amaze me how Aristotle, Fried, Atiyah, McKinnon, Bentham, Austin, Hart, Rackoff, Bennett etc can conjure up these sophisticated and utterly incomprehendable theories by just basing their perspectives on the lives of humans and in their actions in daily life...
if i were to have my own theory... it'll probably be sth like this:
Bryan's Theory of Life: Human beings of reason are creatures who are bound by the worldly influences of this world and have an unending pursuit in their quest for pleasure. They spend their lives finding ways to obtain variable amounts of pleasure, as seen through their actions such as: gaming, sleeping, slacking, drug-taking, smoking, conjuring excuses for ponten-ing classes etc. Most of their actions are revolved around the synopsis that 'life is short, hence enjoy as much as you can until judgement day comes'....
a very crap theory that is definitely gonna be bound by a whole load of criticisms... but if you do analyse it properly.. it DOES contain some truth
anyhow enough of my nonsense... have to run to my evening lecture... take care y'all
